Breaking: Nicholas Ninow leave to appeal application dismissed

Convicted child rapist Nicholas Ninow won’t be getting out of jail anytime soon after the Pretoria High Court dismissed his application for leave to appeal his life sentence on Tuesday 10 March.

He was sentenced to life behind bars in October 2019, as well as a further five years for drug possession. Ninow had told the court that he was under the influence of drugs in September 2018 when he followed a seven-year-old girl into the bathroom of a Dros restaurant in Silverton, Pretoria, and raped her.

Judge Mokhine Mosopa said that Ninow would have to sit out the remainder of his sentence.

He said that Ninow’s response to his conviction, articulated in a letter from his family, had demonstrated regret rather than substantive remorse. He also said the fact that Ninow was under the influence of drugs and alcohol was not compelling enough for a decision to review his sentence.

He said that he had not demonstrated sufficient remorse for his actions, or shown enough reason for the decision to lock him up for life to be overturned.

What’s next for Ninow?

Ninow’s attorney, Herman Alberts, said that his client would lodge an application at the Supreme Court of Appeal.

“I’ll go back to my client and get instructions. The next procedural step would be an application to the president of the Supreme Court of Appeal for a leave to appeal.”
