EFF leader, Julius Malema and Mbuyiseni Ndlozi appeared at the Randburg Magistrates Court, on Wednesday morning, to answer to common assault charges.

Why are the EFF leaders charged with common assault?

The common assault case is related to an incident that allegedly took place at the lte Winnie Madikizela-Mandela’s funeral, in April 2018.

It is alleged that there is CCTV footage that shows how Malema and party spokesperson, Mbuyiseni Ndlozi, allegedly assaulted a SAPS colonel who had been instructed to refuse the EFF vehicle entry into the cemetry.

Initially, the NPA had not indicated any interest in pursuing the matter legally. However, mounting pressure from AfriForum, compelled the State to institute assault charges on Malema and Mbuyiseni Ndlozi.

It is believed that, if it was not for the sustained pressure applied by the lobby group, which had threatened to pursue a mandamus application against the public prosecutorial body in July, the matter would not have been treated as a criminal case in the courts.

EFF accuses NPA of colluding with media

At the Randburg Magistrate’s Court, the gallery was packed with supporters of the SAPS colonel, members of AfriForum, journalists from various publications and NPS spokesperson, Phindi Mjonondwane.

Mjonondwane had told reporters that the media was present because Afriforum had circulated a presser, on Tuesday, inviting journalists to the court.

This view, however, was not shared by Ndlozi, who accused the NPA of colluding with the media and ‘white sympathists’ to exacerbate the nature of the charges and further puport the anti-EFF narrative.

“Of all the cases happening in this country, gender-based violence, murder, heists – but our best supporters [are] the Bokke here (referring to a faction of white guests seated at the gallery) – when a white man says they are assaulted, this is what happens in South Africa,” he said as he panned his camera across the courtroom.
