KZN magistrate in court for alleged driving licence fraud

A KwaZulu-Natal magistrate accused of driving licence fraud is expected back in court today.

According to the Road Traffic Management Corporation, Magistrate Bonginkosi Mtshali (56) is appearing in the Eerstehoek Regional Court with five other suspects for fraudulently procuring a driving licence in 2018.

The magistrate is expected to appear in court on charges of conspiracy to commit fraud and defeating the ends of justice. His co-accused reportedly includes a medical doctor and driving licence examiners.

FIVE MORE SUSPECTS IN DRIVING LICENCE FRAUD

It is alleged that the magistrate and five others conspired to ensure that a driving licence was issued to Magistrate Mtshali fraudulently and by flouting regulations. The offence was reportedly committed in 2018 at the Elukwatini licensing centre.

According to the Road Traffic Management Corporation, the suspects accused of driving licence fraud includes a medical doctor, driving licence examiners and a data capturer.

Simon Zwane, Road Traffic Management Corporation Chief Communications Officer, said the arrest follows an intensive investigation.

“His arrest follows an intensive investigation by the National Traffic Anti-Corruption Unit into the irregular manner in which he obtained his driving licence.”

Police arrested the magistrate on 15 April 2021.

MAGISTRATE ACCUSED OF FRAUD OUT ON R2 000 BAIL

Magistrate Mtshali is currently out on bail. In his first court appearance he was granted bail of R2 000.

Zwane, commenting on the the arrest of the magistrate and his co-accused, said it shows no person is above the law.

“His arrest is a clear demonstration that no one is above the law and that NTACU investigates all allegations without fear or favour.”
